I hereby authorize the unit herein described to be towed to and operated on any waterways or elsewhere for the purposes of testing, inspection, or delivery at my risk. I understand any necessary repairs to the trailer for the purposes of towing, testing or operating the boat are my responsibility and will not be disputed. An express mechanic's lien is acknowledged on the above unit (boat and trailer) to secure the amount of repairs thereto.
I declare that I am the legal owner of the above unit and therefore have the legal authority to authorize repairs. I understand that ownership will be verified with TPWD, and that it is my responsibility to ensure those records are correct. I understand that if it is discovered that I am not the legal owner of the vessel, I will be required to submit proof of ownership and a substantial deposit before repairs will begin.
I understand storage fees of $50 per week will be charged any time the status of the unit is "Waiting for Customer" for 90 days or more. I understand that any necessary notifications will be made to the owner(s) and lien holder(s) on record. I understand that I am responsible for notifying Ben's Boat Repair immediately if my contact information changes. I understand that failure to respond to any contact attempts made by Ben's Boat Repair will be considered evidence of abandonment. I understand any unit declared abandoned will be sold at public auction or donated to the next demolition derby trailer race.
I understand that I may halt the repair process at any time, and that I will be responsible for parts and labor up to the point of cessation, and that I will be charged for reassembly if requested. I understand any storage fees incurred after the cessation of work are my responsibility.
It is also understood that Ben's Boat Repair is not responsible for any damage to the unit (or articles left in the unit) caused by fire, theft, accident, wildlife, inclement weather condition, or any other cause beyond their control, including owner negligence.

I understand the above repairs have a limited warranty. I understand that if I tamper with Ben's work in any way, I will void my warranty. I understand that any failure to follow recommendations for use and operation will void my warranty. It is also understood that any negligence on my part, such as failure to properly prepare my vessel for storage, will also void my warranty.
